Volunteer Waiver

The waiver below is required to volunteer with SWMMBA. Once filling out the waiver completely and submitting it, you will become a member of SWMMBA if you aren’t already and be added to our Trail Work email list. We will email you about upcoming trail work opportunities and ensure you’re kept in the loop about all our volunteer opportunities.

Due to limitations in the form, we recommend reading and filling out the form on a computer. It will still work on a phone, but may be hard to navigate.

Waiver of Liability, Assumption of Risk, and Indemnity Agreement

By signing this document you may be waiving your legal right to a jury trial to hold the provider legally responsible for any injuries or damages resulting from risks inherent in the sport or recreational opportunity or for any injuries or damages you may suffer due to the provider's ordinary negligence that are the result of the provider's failure to exercise reasonable care.  

WAIVER: In consideration of being permitted to participate in any way in Southwest Montana Mountain Bike Association (SWMMBA) activities I, for myself, my personal representatives, assigns, successors, and heirs DO HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE SWMMBA, its directors, officers, employees, volunteers, sponsors, independent contractors, and agents from liability FROM ANY AND ALL CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF SWMMBA or any of the aforementioned parties. The agreement applies to (1) personal injury (including death) from accidents or illnesses arising from participation in a SWMMBA event, group ride or trail work activity; and to (2) any and all claims resulting from the damage to, loss of, or theft of personal property.

ASSUMPTION OF RISK: SWMMBA activities include trail work and mountain bicycling, inter alia, which by nature carry certain inherent risks that cannot be eliminated regardless of care taken to avoid injuries. Risks include, but are not limited to, those caused by terrain, use of tools and trail building implements, facilities, temperature, weather, condition of athletes, equipment, vehicular traffic, actions of other people including, but not limited to, participants, volunteers, spectators, coaches, event officials, and event monitors, and/or producers of the event, and lack of hydration. These risks are not only inherent to participants, but are also present for volunteers.

The specific risks involved can range from (1) minor injuries such as scratches, bruises, and sprains to (2) major injuries such as concussions, broken bones, and heart attacks to (3) catastrophic injuries including paralysis and death.

INDEMNIFICATION AND HOLD HARMLESS: I also agree to HOLD HARMLESS AND INDEMNIFY SWMMBA from all claims resulting from my negligence and to reimburse them for any expenses incurred as a result of my involvement at SWMMBA’s activities. I further agree to pay all costs and attorneys’ fees incurred by SWMMBA in investigating and defending a claim or suit if my claim is withdrawn.

SEVERABILITY:The undersigned further expressly agrees that the foregoing waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by the law of the State of Montana and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident and or illness during this event.

I understand that at this event or related activities, I may be photographed. I agree to allow my photo, video or film likeness to be used for any legitimate purpose by the event holders, producers, sponsors, organizers and or assigns.

I have read the previous paragraphs and I KNOW THE NATURE OF THE ACTIVITIES at issue, I UNDERSTAND THE DEMANDS of those activities relative to my physical condition and skill level, and I APPRECIATE THE TYPES OF INJURIES that may occur as a result of activities made possible by SWMMBA.

I HEREBY CERTIFY that I have read this document; and, I understand its content. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS, INCLUDING MY RIGHT TO SUE. By signing this document, I acknowledge that I signed it freely and without any inducement or assurance of any nature. I INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY to the greatest extent allowed by law in the State of Montana.
